American R&B singer Chris Brown has avoided immediate imprisonment after a London court sentenced him to eight months in prison, suspended for 12 months, over an attack on a music producer at a nightclub in 2023.
The 37-year-old singer was sentenced on Monday, October 26, 2026, at Southwark Crown Court after pleading guilty to affray over the incident at Tape nightclub in Mayfair, London, in the early hours of February 19, 2023.
Brown’s vocal coach and fellow rapper, Omololu Akinlolu, who also participated in the attack, received a four-month prison sentence, suspended for 12 months.
Both men were ordered to pay £1,500 in costs.
The case involved an attack on music producer Abraham ‘Abe’ Diaw, who sustained injuries after Brown struck him with a glass tequila bottle during the incident.
During the sentencing hearing, the court watched CCTV footage showing Brown hitting Diaw four times with the bottle, with two blows connecting with his head. The footage also showed the singer striking the victim’s shoulder.
Prosecutor Heidi Stonecliffe KC told the court that Brown approached Diaw on the dance floor at about 3:00 a.m. and attacked him with a heavy, square-shaped tequila bottle.
The prosecution further stated that Akinlolu joined the assault by punching Diaw in the head. The attack reportedly continued as the victim attempted to escape through the nightclub, with the court hearing that he was also kicked while sitting defenceless on the floor.
The incident lasted between 17 and 20 seconds, according to the defence.
Judge Describes Attack As Dangerous
While delivering his judgment, Judge Tony Baumgartner described Brown’s actions as dangerous, warning that repeatedly striking someone on the head with a glass bottle could have resulted in more serious injuries.
He said the attack involved serious violence, even though it was not planned.
The judge also noted that Brown had to be physically pulled away from the victim during the incident.
According to the judge, violence in a crowded nightclub poses a danger not only to the person being attacked but also to other people in the vicinity.
He emphasised that Brown’s celebrity status, commercial success and professional achievements did not entitle him to special treatment under the law.
However, the court considered several factors before deciding against immediate imprisonment, including Brown’s guilty plea, his compliance with bail conditions and the potential effect of a prison sentence on his four children.
The judge also concluded that the singer presented a low risk of committing further offences.
Why Brown Was Not Sent To Prison
Despite describing the incident as serious enough to warrant custodial sentences, Judge Baumgartner said recent changes to sentencing laws meant the prison terms had to be suspended unless exceptional circumstances justified immediate imprisonment.
The judge said he had considered whether the seriousness of the offences, together with the need for punishment and deterrence, justified sending the two men straight to prison.
He concluded that the circumstances did not meet the threshold for making an exception to the new legal requirement.
As a result, Brown and Akinlolu will not serve their prison sentences unless the terms of their suspension are breached in a way that leads to activation of the sentences.
Victim Received Hospital Treatment
Following the attack, Diaw was taken to St Mary’s Hospital in London for medical treatment.
The court heard that he was discharged with pain relief after being diagnosed with a head injury and a superficial knee injury.
An MRI scan conducted in early March reportedly revealed a high-grade injury to a ligament on the inner side of his left knee.
However, Brown’s defence lawyer, Sallie Bennett-Jenkins KC, disputed the extent of the injuries, arguing that the incident did not result in fractures or broken skin.
The defence described the attack as a brief incident that Brown deeply regretted.
Bennett-Jenkins told the court that the singer apologised to those who witnessed the incident and acknowledged the distress it may have caused.
The court also heard that Diaw was no longer supportive of the prosecution and had withdrawn his support some time after the incident.
Brown Had Faced More Serious Charges
Brown and Akinlolu pleaded guilty to affray at Southwark Crown Court in July 2026.
The singer had initially been scheduled to stand trial over more serious allegations, including assault, attempting to cause grievous bodily harm and possession of an offensive weapon. Those charges were subsequently dropped.
Akinlolu’s lawyer, Laurie-Anne Power KC, told the court that her client genuinely believed Brown was under attack when he intervened.
She described the relationship between the two men as close, saying Akinlolu regarded Brown as a brother. However, he accepted responsibility for his involvement in the incident.
Cheers As Chris Brown Leaves Court
After the sentencing, Brown and Akinlolu stood facing each other and clasped hands before leaving the courtroom.
Brown was greeted by loud cheers from supporters outside the court. He also appeared to stop to sign an autograph before departing.
The singer later shared a video on his Instagram Story showing him inside a car, looking out of the window before turning towards the camera and giving a thumbs-up.
Brown remains one of the most commercially successful figures in contemporary R&B, known for hit songs such as Forever, Yeah 3x, Run It, Turn Up the Music and Don’t Wake Me Up.
The suspended sentence brings the criminal proceedings over the 2023 London nightclub attack to a sentencing conclusion, although Brown could face imprisonment if the conditions of his suspended sentence are breached and the sentence is activated.
