FG Files 13-Count Treason Charges Against Sylva, Six Others Over Alleged Coup Plot

President Bola Tinubu has signed the Presidential Executive Order on Virtual Assets Coordination, 2026, establishing a unified framework to regulate virtual assets and strengthen Nigeria's digital economy. The President signed the order pursuant to Section 5 of the 1999 Constitution (as amended), and it took effect immediately, according to a statement issued Friday by presidential spokesperson, Bayo Onanuga. The statement explained that the order was designed to address a fragmented regulatory landscape, where overlapping and disjointed oversight by government agencies had exposed Nigerians to risks such as money laundering, terrorism financing, cybersecurity threats, fraud and revenue losses. It noted that unregistered operators had exploited these gaps in the past to defraud unsuspecting citizens. To close these loopholes, the order establishes a Virtual Asset Council chaired by the Central Bank of Nigeria (CBN), with the Nigeria Revenue Service (NRS) and the Securities and Exchange Commission (SEC) serving as vice-chairs. Other members include the Nigerian Financial Intelligence Unit (NFIU) and the Office of the National Security Adviser (ONSA). The Council will set policy direction, foster cooperation among the agencies, and collaborate with the Attorney-General of the Federation to build a harmonised legal and institutional framework for the sector. A Virtual Asset Office will also be created as the Council's operational arm, with its secretariat based at the CBN. The office will coordinate information sharing, applications and reporting among agencies through an integrated supervisory technology platform. The statement clarified that the order does not create a new regulator or strip any agency of its existing powers. Instead, registration of virtual asset activities will be determined by the nature of the asset involved — the SEC will register security-related activities, while the CBN will handle payment, settlement, custody and other non-security virtual asset services. The Council will resolve any disputes over jurisdiction. As part of the coordinated approach, the CBN is proceeding with a regulatory sandbox that will allow eligible operators to test virtual asset products and blockchain-based solutions under close supervision before they reach the wider market. The NRS is also expected to release a tax policy for the virtual assets sector to strengthen compliance and ensure the industry contributes fairly to national revenue. Additionally, the Federal Government is finalising a Virtual Assets White Paper that will outline the country's long-term policy direction for the sector. The Council has been given 30 days to develop a Harmonised Implementation Framework to guide agencies in enforcing the order.

The Federal Government has instituted a 13-count charge before the Federal High Court in Abuja against six individuals, including two retired military officers and a serving police officer, over an alleged plot to wage war against the Nigerian state and engage in terrorism.

Those named in the charge are Major General Mohammed Ibrahim Gana (retd), Captain Erasmus Ochegobia Victor (retd), Inspector Ahmed Ibrahim, Zekeri Umoru, Bukar Kashim Goni, and Abdulkadir Sani.

They are expected to be arraigned on Wednesday, April 22, before Justice Joyce Abdulmalik.

Also listed in the charge, but currently at large, is former Minister of State for Petroleum Resources, Timipre Sylva.

The case was filed by the Office of the Attorney-General of the Federation and signed by the Director of Public Prosecutions, Rotimi Oyedepo. The defendants face charges ranging from treason and terrorism to failure to disclose security intelligence and money laundering.

According to the prosecution, the accused allegedly conspired in 2025 to undermine the authority of President Bola Ahmed Tinubu and destabilise the country. They were said to have planned to “levy war against the state” in violation of Section 37(2) of the Criminal Code.

The government further alleged that the defendants had prior knowledge of a planned treasonable act involving Colonel Mohammed Alhassan Ma’aji and others but failed to report it to the appropriate authorities or take steps to prevent it.

In addition to treason, the defendants are being prosecuted under the Terrorism (Prevention and Prohibition) Act, 2022, for allegedly conspiring to carry out acts capable of disrupting Nigeria’s constitutional order.

Inspector Ahmed Ibrahim and Zekeri Umoru were specifically accused of attending meetings connected to the alleged plot, with prosecutors claiming their actions were aimed at advancing a political agenda that could destabilise the country.

The charge also includes allegations of providing material support for terrorism and withholding intelligence that could have thwarted the planned acts.

Alleged Terror Financing

The Federal Government further accused some of the defendants of involvement in terrorism financing and money laundering.

Bukar Kashim Goni was alleged to have retained ₦50 million linked to proceeds of terrorism financing, while Abdulkadir Sani allegedly held ₦2 million from a similar source.

Zekeri Umoru was accused of receiving ₦10 million in cash outside the formal financial system and retaining an additional ₦8.8 million suspected to be tied to terrorism financing.

Inspector Ahmed Ibrahim was also alleged to have taken possession of ₦1 million connected to the scheme.

All financial-related charges were filed under the Money Laundering (Prevention and Prohibition) Act, 2022.
